The Gurugram biker crash case has taken a dramatic turn after police arrested accused Kalyan Bainsla in Rajasthan and added an attempt-to-murder charge following a detailed analysis of CCTV footage.
Bainsla was arrested from Rajgarh in Rajasthan on September 15, two days after his car allegedly rammed into a woman biker on Gurugram’s Golf Course Road. The incident, captured on camera and shared widely on social media, triggered widespread outrage.
The biker, identified as Shivani Chauhan, who uses the name Sia, had alleged that the car chased her before hitting her motorcycle. Police initially registered a case under sections relating to rash driving and causing hurt. The FIR was later expanded after investigators examined the available footage.
Attempt-to-Murder Charge Added
Gurugram Police Commissioner Sibash Kabiraj said Section 109 of the Bharatiya Nyaya Sanhita (BNS), relating to attempt to murder, has been added to the case after a detailed CCTV analysis. The provision carries a maximum punishment of up to 10 years’ imprisonment.
Police had earlier registered the case at Sector 56 Police Station under Sections 281 and 125 of the BNS, concerning rash driving and acts endangering life or causing hurt. The investigation is now focused on reconstructing exactly what happened in the moments leading up to the collision.
What Does Sia Say?
Sia has strongly rejected Kalyan Bainsla’s account that the crash was accidental. She alleges that the car came dangerously close to her, that the occupants repeatedly gestured for her to stop and that she was eventually hit deliberately. She has also questioned why the driver did not stop after the collision if, as he later claimed, he felt sorry for her.
In interviews and social-media posts, Sia has described the incident as extremely frightening and said she felt unsafe on the roads despite riding with other bikers. She has also alleged that the occupants appeared to be intoxicated. That allegation remains part of the competing accounts being examined in the investigation.
What Is Kalyan Bainsla’s Defence?
The accused Kalyan Bainsla has denied deliberately hitting Sia. According to his account, a group of bikers had been speeding past his vehicle and he had asked them to slow down. He claimed he did not realise that a woman was riding the motorcycle and said he lost control near a U-turn, resulting in the collision.
He admitted that the crash was his fault but denied that he intentionally rammed the bike. Bainsla has also said he fled because he feared being attacked by the group of bikers travelling with Sia.
Kalyan Bainsla hails from Haryana’s Palwal and runs multiple gyms, along with claiming to be a sports athlete and a powerlifter.
Viral Video Changed the Case
The case gained national attention after footage from cameras mounted on the motorcycles showed the moments surrounding the crash. The videos appear to show the car moving towards Sia’s motorcycle before the collision, after which she was thrown from the bike and the motorcycle skidded along the road.
The footage prompted Gurugram Police to take suo motu cognisance of the incident and register a case. The latest arrest and the addition of Section 109 mean the case has now moved well beyond a routine road-accident investigation.
What Happens Next?
Police are expected to question Bainsla and examine the CCTV footage, statements and other evidence to establish the sequence of events and the intent behind the collision. For now, the central question remains:
Was this a road-rage crash that spiralled out of control — or was the biker deliberately targeted? The answer will depend on the evidence gathered during the investigation.
